Competence

The Croatian Railway Safety Agency is a national safety authority within the meaning of railway legislation of the European Union, entrusted with the task of regulating and supervising safety of the Croatian railway system.

The Law on Safety and Interoperability of the Rail System (Official Gazette No. 82/13) proclaims the activities of the Agency as activities of special interest to the Republic of Croatia.

The Agency is competent to perform tasks related to the safety of the railway system, especially activities related to safety certificates and safety authorisations, approvals, licences and other authorizations; supervision and inspection activities – with the goal of ensuring continuous compliance with the safety requirements; as well as keeping of registers. The Agency has also other tasks, laid down in the Law on Safety and Interoperability of the Rail System and directly applicable EU legal acts.

In particular, the Agency has the following competences:

a) the issue and revocation of safety certificates, checking that required conditions are met and that railway undertakings are operating in line with the Law on Safety and Interoperability of the Rail System and directly applicable EU legal acts;

b) the issue and revocation of safety authorisations, checking that required conditions are met and that infrastructure managers are operating in line with the Law on Safety and Interoperability of the Rail System and directly applicable EU legal acts;

c) authorising the placing in service of the structural subsystems;

d) checking that structural subsystems are operated and maintained in accordance with the relevant essential requirements;

e) supervising that the interoperability constituents are in compliance with the essential requirements;

f) managing the vehicle registry and supervising that safety related information contained therein, is accurate and kept up to date;

g) supervision of safety management systems;

h) inspection on implementation of the Law on Safety and Interoperability of the Rail System and directly applicable EU legal acts;

i) monitoring, promoting, and enforcing the safety regulatory framework including participation in adoption of by-laws;

j) adoption of mandatory guidelines in connection with its competences;

k) authorising test sections for the purpose of testing of subsystems and parts of subsystems.

 

In relation to certification of train drivers (Heading XV of the Law on Safety and Interoperability of the Rail System ) the Agency has the following competences:

a) issuing licences and providing duplicates;

b) conducting periodic checks for the validity of licences;

c) suspending and withdrawing licences and notifying the issuing body of reasoned requests for the suspension of certificates due to non-fulfilment of necessary requirements;

d) authorising training centres and examiners;

e) publishing and updating the registry of authorised training centres and examiners;

f) keeping and updating s register of licences;

g) monitoring the drivers’ certification process under a quality standards system;

h) supervising competences of train drivers.

 

Furthermore, the Agency conducts an active exchange of views and experience with national safety authorities of other EU member states for the purpose of harmonising the decision-making criteria, in particular aiming at facilitating and coordinating the safety certification of railway undertakings which have been granted international train paths.
